This Disclaimer explains the basis on which Adsy Media (operated by Kairen Whittock), carrying on business as Adsy Media (“we”, “us”, “our”), publishes the articles, analysis, interviews, rankings, data and other material on adsy-media.com (the “Site”). It forms part of, and is to be read with, our Terms & Conditions. Where this Disclaimer and the Terms & Conditions address the same subject, both apply and the more specific provision governs.
1. General information only
Adsy Media is an independent online magazine covering technology, startups, funding, product launches, policy and the business of building companies. Everything we publish is general information and journalism. It is written for a broad readership, without knowledge of your circumstances, objectives, risk tolerance, tax position, jurisdiction or contractual obligations. It is not tailored to you, and it must not be treated as a recommendation to take or refrain from any action.
You are solely responsible for evaluating the Content and for any decision you make. Before acting, obtain advice from a qualified professional who is licensed in your jurisdiction and who can consider your particular facts.
2. No professional relationship
Reading the Site, subscribing to a newsletter, commenting, or corresponding with our editors or contributors does not create any advisory, fiduciary, agency, solicitor-client, accountant-client, engineering, brokerage or other professional relationship between you and us or between you and any of our contributors. No duty of care of that kind is assumed, and none should be inferred from the tone, specificity or confidence of any article.
3. No financial, investment or securities advice
This section is important, because much of our coverage concerns startups, venture capital, funding rounds, valuations, tokens, public listings and company performance.
- Nothing on the Site is investment advice, a recommendation, a rating, or an inducement to buy, sell, subscribe for, underwrite or hold any security, derivative, digital asset, fund interest or other financial instrument.
- Nothing on the Site is an offer to sell or a solicitation of an offer to buy any security, in any jurisdiction, to any person. Where we report that a company has raised or is raising capital, we are reporting news; we are not distributing, promoting or participating in that offering, and we are not a party to it.
- We are not registered in any capacity under Canadian securities legislation. We are not a dealer, adviser, investment fund manager, portfolio manager, exempt market dealer or crypto-asset trading platform. In Canada, securities regulation is provincial and territorial rather than federal: each province and territory has its own securities legislation and its own regulator, and those regulators coordinate through the Canadian Securities Administrators. If you are considering an investment, confirm the registration of any person soliciting you and the availability of any prospectus exemption being relied on, using the CSA’s National Registration Search and the disclosure filed on SEDAR+. Readers outside Canada should consult the regulator with jurisdiction over them.
- Valuations, funding figures and financial data that we report are typically drawn from company statements, investor statements, regulatory filings, market databases and sources speaking on background. Private-company valuations are negotiated, unaudited, frequently structured with preferences and side letters, and are not a market price. Reported round sizes may combine primary and secondary capital, debt, equity, convertible instruments and unexercised commitments. Treat every such figure as a reported claim, not a verified fact.
- Past performance, growth rate, funding momentum or press attention is not indicative of future results. Early-stage and private investments are illiquid, are frequently unsuitable for retail investors, and carry a material risk of total loss.
- Neither we nor our contributors accept responsibility for any investment or divestment decision, or for any trading loss, opportunity cost or tax consequence, arising from Content on the Site.
4. No legal or tax advice
Articles about regulation, litigation, privacy law, competition law, employment, immigration, intellectual property, corporate structuring, tax credits, incentives or cross-border compliance are journalism about the law, not legal or tax advice. Legislation, regulation, guidance and case law differ by jurisdiction, change frequently, and often turn on facts we do not know. Our summaries are necessarily compressed and may omit exceptions, transitional rules and provincial variations. Do not rely on the Site to determine your rights or obligations; consult a lawyer or tax adviser qualified in the relevant jurisdiction.
5. No engineering, product or security advice — use at your own risk
We publish technical explainers, benchmarks, architecture discussions, tool comparisons, configuration walkthroughs and coverage of vulnerabilities and incidents. This material is provided for information only and without warranty of any kind.
- Do not deploy a configuration, command, dependency, script, model or security control described on the Site into a production environment without independent review and testing appropriate to your risk.
- Benchmarks reflect a specific environment at a specific time and may not reproduce on your hardware, in your region, at your scale, or on a later software version.
- Coverage of a vulnerability, exploit or breach is descriptive reporting. It is not an instruction to attempt anything, not authorisation to test any system you do not own, and not a substitute for your vendor’s advisory or your own security team’s assessment.
- Any code or command reproduced on the Site is provided as an illustration, with no warranty of correctness, safety, security or fitness for purpose. You assume all risk of loss, corruption, downtime or compromise.
6. Accuracy, timeliness and change after publication
We take reasonable editorial care, but we make no representation or warranty that the Content is accurate, complete, current or free from error or omission. In particular:
- Prices, subscription tiers, free-tier limits, model availability, API terms, hardware specifications and regional availability change frequently and often without notice.
- Funding rounds are sometimes announced before they close, restructured, downsized or withdrawn; headcount, revenue, run-rate and user numbers are usually company-provided and unaudited.
- Statutes, regulations, regulatory guidance and court decisions may be amended, appealed, stayed or repealed after we write about them.
- Screenshots, product behaviour and interface descriptions reflect the version we tested on the date stated.
Every article should be read as accurate as at its publication or last-updated date, which appears on the article. We are under no obligation to update Content, and the continued availability of an article does not mean we have re-verified it.
7. External links and third-party material
The Site links to third-party websites, filings, datasets, repositories, videos and social media posts. We do not control that material, we do not adopt or endorse it, and we are not responsible for its accuracy, legality, security or availability, or for the privacy practices or terms of the sites on which it appears. Quotations from named or unnamed sources represent the statements of those sources, not our findings, unless we say we have verified them.
8. Testimonials, results and earnings claims
- Any testimonial, founder quote, case study, customer story or user comment on the Site reflects the individual experience or opinion of the person who gave it. It is not typical, not verified unless expressly stated, and not a promise that you would obtain a similar result.
- We do not make, and we do not authorise anyone to make on our behalf, any earnings, income, revenue, growth or fundraising claim. Where an article reports what a company, founder or investor says about outcomes, we are reporting a claim.
- Where a testimonial or endorsement is connected to a commercial arrangement, that connection is disclosed as described in our Affiliate Disclosure.
- Nothing on the Site should be understood as a guarantee of any business, career, hiring, funding or financial outcome.
9. Third-party trade-marks, fair dealing and commentary
Company names, product names, logos and screenshots belonging to third parties appear on the Site for the purposes of identification, news reporting, review, criticism and commentary. All such marks remain the property of their respective owners. Their use here is nominative and is intended to fall within fair dealing under the Copyright Act (Canada) and comparable doctrines elsewhere, including fair use under United States law. Their appearance does not imply affiliation with, sponsorship by, or endorsement from the owner, in either direction. If you are a rights holder and believe material on the Site exceeds those limits, the procedure in our DMCA Policy applies.
10. Use of AI assistance in production, and human editorial review
We use software tools, including machine-learning and generative artificial-intelligence tools, in parts of our production workflow. Depending on the article, that may include transcription of interviews, translation, summarising long public documents and filings, generating research leads and question lists, copy-editing and headline variants, structured-data extraction, illustration or diagram assistance, and code formatting.
Our standing commitments are:
- every article published on the Site is reviewed and approved by a human editor before publication, and a named human is accountable for it;
- we do not publish wholly machine-generated articles as though they were reported journalism;
- factual assertions, quotations, figures and citations are checked against primary sources by a person, not accepted from a model;
- where AI-generated imagery is used, we label it as such;
- where the use of an AI tool is material to how a story was produced, we say so in the article.
Notwithstanding those commitments, automated tools can introduce errors, and this Disclaimer applies to Content produced with their assistance in exactly the same way as to Content produced without it.
11. Errors and corrections
We correct the record. If you believe something we published is factually wrong, incomplete, misattributed or out of date, please write to [email protected] with the article URL, the specific passage, what you say is incorrect, and any supporting source. Our practice is to:
- acknowledge substantive correction requests promptly;
- verify the point against primary sources;
- correct a material factual error in the article itself and append a dated correction note explaining what changed;
- make silent fixes only for immaterial matters such as typography, formatting or broken links;
- unpublish only in exceptional circumstances, such as a legal requirement or a serious risk to a person’s safety, and to note publicly that we have done so.
Requests that concern personal information, rather than editorial accuracy, are handled under our Privacy Policy. Requests that concern copyright are handled under our DMCA Policy.
12. Limitation of liability
To the maximum extent permitted by applicable law, neither Adsy Media (operated by Kairen Whittock) nor its officers, directors, employees, editors, contributors, contractors, licensors or suppliers will be liable for any loss or damage of any kind, whether direct, indirect, incidental, special, consequential, exemplary or punitive, including loss of profit, revenue, business, goodwill, opportunity or data, arising from or in connection with your access to, use of, or reliance on the Site or the Content, or from any error, omission, interruption, delay or unavailability, whether the claim is framed in contract, tort (including negligence), breach of statutory duty or otherwise. The liability cap and the survival, governing-law and venue provisions in our Terms & Conditions apply to this Disclaimer. Some jurisdictions do not allow certain exclusions or limitations, and in those jurisdictions our liability is limited to the least amount permitted by law. Nothing here excludes liability for fraud or any other liability that cannot lawfully be excluded.
